Blue Sky Rush – Terms of Use:

In App Purchases:

-These give you access only to the particular page you have purchased eg one of the periodically released Extra Selection or Longer Reads pages (ie not both of them), depending on which one you purchased. When new pages are released, eg an Autumn Extra selection, then you will need to make a new purchase to access these new pages.

-we reserve the right to cancel purchases at any point, we will try to give advance notice, but this may not be possible.

-Where you have a subscription you may cancel the renewal at any point uptil the monthly renewal date. You do this by going to your Phone's App Settings.

-All work is subject to Copyright, and in particular you may not share or distribute Extras/Longer Reads pages content eg post on the internet, except any items marked as available under a Creative Commons license, in which case you may only distribute those items.

General:

-you are only licensed to use the app for personal purposes, and have no ownership rights whatsoever

-for Apple Users, the relevant End User License Agreement (EULA) is Apple’s Standard EULA for Apps, and so the licensing parts of these terms do not apply

-we may revoke your right to use the app at any time, for any reason, without notice

-the app may be discontinued, no longer supported, or modified at any time.  In such case we will try to give advance notice, but this may not happen.

-you agree to defend, indemnify and hold us (& also any of our Employees / Directors / any other person involved with the App) harmless against any claims, actions or demands (including reasonable legal fees) resulting from your use of the App*

-you understand and agree that your use of the App* is at your own risk, and it is provided on an 'as is' and 'as available' basis, and is provided without warranties of any kind

-the app* may make references or provide links to other websites / companies etc – we have no control over and take no responsibility for any content or actions of these third parties.

-you understand and agree that to the maximum extent permitted by applicable law, in no event shall we (& also any of our Employees / Directors / any other person involved with the App*) have any liability to you for any indirect damages, or for any direct damages greater than $100 or the amount you have paid for In App purchases on the app, whichever is the higher.

-we do not normally accept photos for use on the App*, however in the event that you do provide us with any photos, and we use them, then you agree we can use them under a free for Commercial Use, Creative Commons CC0 license.

Privacy:

-Buildfire's terms of use (refer link available on the Settings section of the App / their website) include a detailed Privacy Policy concerning the App’s data use

-part of this explains that data may be transferred to the United States and any other countries if required

-in addition Blue Sky Snow Day Limited may process data for its internal records, its commercial purposes, and where needed for the App to function. This would be under the Contractual Basis for example in case of In App Purchase, for its own Legitimate Interests of providing and improving the App, where Legal Requirements apply and Consent for certain push notifications (nb: you can turn off notifications at anytime via your phone's Settings). 

-Data will be retained for the minimum period required to achieve this, we anticipate this would often be less than a year, but with certain data retained for longer, for example to comply with retention requirements of Government Bodies.

-We may share your data where necessary for providing the App, for example with Buildfire or an App Store; and may disclose it where required for example if requested by relevant Government Bodies.

-This would mostly be aggregated data, but may include specific items.

-It may also include transfers to other countries such as the United States (where the App is hosted), the United Kingdom and other countries in the European Union.

-We do not require log in to use the App, and currently have no plans to directly market you, eg via e-mail. But if this changes we would seek your consent first, and you would have the right to object.

-Blue Sky Snow Day Limited can be contacted in its role as Data Controller at the email address below.

Misc:

-you should also note Buildfire's terms of use (refer link available on the Settings section of the App / their website)

-you may not assign or transfer any rights concerning your use of the App without our written consent. We may assign or transfer any such rights without consent.

-we may vary these terms at any time at our sole discretion, if you do not agree with any changes then you must cease using the app

-should you have a dispute with Blue Sky Snow Day Limited the English courts will have exclusive jurisdiction over any claim arising from this although we retain the right to bring proceedings against you for breach of these terms in your country of residence or any other relevant country

-these Terms and any dispute with Blue Sky Snow Day Limited shall be governed by and construed in accordance with the law of England and Wales

-in the event that any of these terms are deemed invalid or unenforceable or we choose to waive them, that has no impact on all the other terms which still stand.
